Family Based Immigration
The two main ways to obtain a green card are through family and employment. Family based immigration is when a US Citizen files an application to sponsor their foreign born spouse, child, parent or sibling for legal permanent residency. It also includes Legal Permanent Residents applying for their Spouse or Child. For those that are considered immediate relatives, (US Spouse, Child or Parent), a visa is immediately available and the only waiting is the processing time of the application. Non-Immediate Relatives for into a visa quota and must wait a certain period of time for a visa to become available. This is because the United States limits the amount of visas it issues per year based on the degree of relative and the Country or area of the world they live. The Department of State issues a visa bulletin each month which states the priority date of which it is currently issuing green cards for each category.
Depending on your status and whether you are in the US or abroad, you will be eligible for either Adjustment of Status or Consulate Processing. Adjustment of Status can be filed concurrently with the visa application if the immigrant is in the US and has no inadmissibility issues. Depending on the family relationship, an interview before USCIS may be required before the green card application can be approved. Family members that are abroad obtain their permanent residency through Consular Processing at the US Consulate in their native country. They then enter the US as a legal permanent resident.
The process of obtaining permanent residency in the US requires a substantial amount of biographical information and proof of the relationship along with a medical exam and a background check. The US or LPR Sponsor must also be able to prove that they will be able to support their relative by filing an Affidavit of Support.
